Terms and Conditions

1. Subject Matter of the Contract; Contracting Party

1.1. These Terms and Conditions ("T&Cs") apply to the sale of restaurant vouchers ("Vouchers") by PayNowEatLater GmbH ("BON BON").

1.2. Your purchase contract is concluded with PayNowEatLater GmbH, Schulterblatt 58, 20357 Hamburg, Email: info@bon-bon.de, Website: www.bon-bon.de.

2. Conclusion of Contract

2.1. The contract is concluded when BON BON accepts the offer contained in your order. The presentation of vouchers on BON BON's website does not constitute a legally binding offer by BON BON. All your inputs are displayed in an order summary before you place a binding order and can be corrected at that stage. By clicking the "Buy Now" button, you submit a binding order for the vouchers in your shopping cart. Confirmation of receipt of your order is sent immediately by email. This confirmation also serves as acceptance of the contract.

2.2. BON BON does not store the contract text for you but will send your order details as a PDF via email. The T&Cs can also be viewed, printed, and saved on the website.

2.3. The contract language is German.

3. Restaurant Vouchers

3.1. Restaurant vouchers from our voucher partners represent a right granted by the respective voucher partner to receive prepared food and beverages from the voucher partner and/or its acceptance partners. This means that you cannot redeem the restaurant voucher with BON BON.

3.2. Exchanging these restaurant vouchers for cash with the voucher partner and/or its acceptance partners is not possible.

3.3. The voucher partner's terms and conditions apply to the right embodied by the restaurant voucher (including any deadlines for redeeming the restaurant voucher).

4. Delivery Terms

4.1. Vouchers are delivered in either physical form or electronic form via email, depending on the order.

4.2. Physical vouchers can only be delivered to an address within Germany. Delivery to P.O. boxes or packing stations is excluded. Delivery time for physical vouchers is up to five business days from the conclusion of the contract. Business days exclude Saturdays, Sundays, and public holidays in Hamburg.

4.3. Electronic vouchers are delivered within one business day of order placement to the email address you provide.

5. Payment Terms

5.1. All prices are total prices and include applicable VAT. Any additional shipping costs will be indicated separately.

5.2. Payment can be made using the following methods: credit cards from VISA, Mastercard, American Express, or PayPal. To mitigate credit risk, BON BON reserves the right to exclude certain payment methods in individual cases.

5.3. Restaurant vouchers may also be purchased using a gift voucher instead of payment.

5.4. Payment is due upon conclusion of the contract.

6. Data Protection

If BON BON processes personal data, our privacy policy applies. It can be accessed in its current version at https://www.bon-bon.de/datenschutz/.

7. Information About the Existence or Non-Existence of a Right of Withdrawal

7.1. If you are a consumer and purchase a physical voucher, you have the right to withdraw from the contract as outlined below.

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.

To exercise your right of withdrawal, you must inform us (PayNowEatLater GmbH, Schulterblatt 58, 20357 Hamburg, Email: info@bon-bon.de) by a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs arising if you choose a delivery method other than the least expensive standard delivery we offer), without undue delay and no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same payment method used for the initial transaction, unless you expressly agree otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the fourteen-day period has expired. We will bear the cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

7.2. If you are a consumer and purchase an electronic voucher, the following withdrawal rights apply:

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the date of the contract conclusion.
To exercise your right of withdrawal, you must inform us (PayNowEatLater GmbH, Schulterblatt 58, 20357 Hamburg, Email: info@bon-bon.de) by a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

For this reimbursement, we use the same payment method as for the original transaction, unless expressly agreed otherwise; in no case will you be charged fees for this reimbursement.

End of Withdrawal Policy

In the following cases, you cannot withdraw from the contract:
The right of withdrawal for a contract regarding the delivery of digital content not stored on a physical data carrier expires if BON BON begins contract execution before the withdrawal period ends and you expressly agree to this and confirm your acknowledgment that your right of withdrawal is lost when contract execution begins.
